1. Acceptation des Conditions

By using the ESPACE BENIN site, you agree to comply with these Terms of Use.

2. Description du Service

ESPACE BENIN is an online platform aimed at facilitating the search and connection for the rental and sale of real estate and various properties in Benin. We aggregate offers from different partner agencies and individuals.

3. Utilisation du Site

• The information provided on the site (descriptions, prices, availabilities, contacts) is published by our partners and is under their responsibility. ESPACE BENIN strives to keep the information up-to-date but cannot guarantee its absolute accuracy.
• You use the site to search for properties and contact partners through the means provided (WhatsApp, etc.).
• Any transaction (rental, purchase, reservation, payment) is made directly between you and the relevant partner, or via the FedaPay payment platform for reservation/advance payment fees when offered. ESPACE BENIN is not a party to the final rental/sale agreements and cannot be held responsible for any disputes related to these agreements.
• Reservation or rent/advance payments made via the provided FedaPay links directly involve the user and the final recipient of the payment (agency/owner via FedaPay). FedaPay's terms also apply.
• Reservation fees, once paid via FedaPay, are generally non-refundable (unless specific conditions are mentioned by the partner or Espace Benin) and give you a limited-time priority for the property concerned.
• You can change properties and benefit from the refund of reservation fees, always respecting the eight (08) day period.
• If you choose not to rent *any* property through ESPACE BENIN within the stipulated period (e.g., 8 days after reservation), you will lose your reservation fees.
• You agree not to use the site for illegal purposes or purposes prohibited by these terms.

4. Espace Administrateur/Partenaire

• Access to the administration area is reserved for authorized partners.
• Partners are responsible for the accuracy and legality of the information they publish (including their contact information).
• Partners must ensure that properties marked as "Paid" or "Reserved" are indeed so and keep the statuses updated in the administration interface.

5. Témoignages

• By submitting a testimonial, you grant ESPACE BENIN the non-exclusive right to publish it on the site and potentially on other promotional materials.
• You warrant that your testimonial is truthful and does not violate any third-party rights.

6. Limitation de Responsabilité

• ESPACE BENIN acts as a technical intermediary and cannot be held responsible for the quality of the properties, the outcome of final transactions, or the actions of users or partners.
• We are not responsible for payment failures or issues related to the FedaPay platform, although we facilitate the integration.
• We do not guarantee uninterrupted or error-free access to the site.

7. Propriété Intellectuelle

The site's content (texts, images provided by Espace Benin, logo, design) is the property of ESPACE BENIN or its licensors and is protected by intellectual property laws. Images of properties belong to the partners who publish them.

8. Modifications des Conditions

We reserve the right to modify these conditions at any time. Modifications will take effect upon their publication on the site. Your continued use of the site after modification constitutes acceptance of the new conditions.

9. Droit Applicable

These conditions are governed by Beninese law. Any dispute will be submitted to the competent courts of Benin.
